Can I Force my Spouse Out of the House?

with Sergio. I am your host Sergio Cabanas the founder of the Cabanas Law Firm. One question I’m often asked is whether or not I can force my spouse out of the house during a divorce proceeding. Well there’s, it’s a complicated issue but usually the answer is no. That is that both spouses have the right to remain in the house until otherwise ordered by the court or until the divorce is finalized. Now that doesn’t mean you have to stay in the house. You’re free to move in and out of the house as you choose. Oftentimes, clients come in with a misconception that if they move out of the house it’s somehow going to be held against them in a divorce. That concept doesn’t really exist when it comes to divorce cases. You can move out, you just can’t force the other spouse to move out if he or she doesn’t want to.
